Election Petition Hearing Fixed

The Supreme Court will on April 16 2013 begin hearing the substantive case of the election petition challenging the validity of the 2012 presidential election.
The petition was filed by Nana Addo Dankwa Akufo-Addo New Patriotic Party, (NPP) presidential candidate for the 2012 elections, his running mate Dr. Mahamudu Bawumia and the party’s chairman, Jake Otanka Obetsebi-Lamptey, who are claiming the December 7 election was rigged by the Electoral Commission in favor of President Mahama.
They named President John Mahama, the Electoral Commission and the Chairman of the Commission, Dr. Kwadwo Afari Gyan as respondents.
On Tuesday the Supreme Court asked the petitioners in the case to file affidavit of witnesses they intend to call.
The court decided on the two issues to be litigated by the parties involved in the petition, based on which they would give their ruling after the parties in the case have advanced their arguments.
The court would first establish whether or not there were statutory violations, irregularities, omissions and malpractices in the 2012 general elections.
The court would also ascertain whether violations, irregularities, omissions and malpractices affected the results of the election.
